Personal data processing policy

As part of its business activities, SEGUIN MOREAU may collect and process personal data about you.

The purpose of this personal data management policy is to inform you about the processing of your personal data and your rights in relation to this processing (the “Personal Data Processing Policy”).

 

1. Definitions

“SEGUIN MOREAU” refers to SEGUIN MOREAU & C°, a simplified joint stock company with a capital of 4,391,268.24 Euros, headquartered at Zone Industrielle le Petit Oumelet, 16100 Merpins, France and registered with the Angoulême trade and companies register under number 905 920.

“Personal Data” means any information relating to a natural person who can be identified either directly or indirectly.

“The Site” means the SEGUIN MOREAU website accessible at the following address: www.seguin-moreau.fr.

 

2. Data controller

SEGUIN MOREAU is the controller of the Personal Data it collects, in accordance with the rules set out in Data Protection Regulation n°2016/679 of the European Parliament and of the Council of 27 April 2016, known as the “General Data Protection Regulation”, and in French Law n°78-17 of 6 January 1978 relating to information technology, data files and civil liberties, known as the “Data Protection Act” (the “GDPR Regulation”)

 

3. Personal data

SEGUIN MOREAU mainly processes the following Personal Data:

  • Personal Data transmitted by SEGUIN MOREAU’s clients, intermediaries, suppliers and service providers;
  • Personal Data communicated to SEGUIN MOREAU by candidates in the context of recruitment;
  • Personal Data communicated to SEGUIN MOREAU through the Site.

In particular, this Personal Data may concern data relating to the following elements:

  • Identity: surname, first name;
  • Contact details: email address and business telephone number, region, country;
  • Professional life: position, company, languages spoken;
  • Job application: email, address and personal telephone number, photo, experience, skills, level of education, hobbies;
  • Browsing data: IP address, data relating to users’ equipment and browsers, cookies and trackers (for more information on the cookies used, click here)

4. Purpose – legal bases

Personal Data is collected and processed to enable SEGUIN MOREAU to:

  1. Manage commercial relations with customers, intermediaries, suppliers and service providers;
  2. Manage applications;
  3. Communicate information about SEGUIN MOREAU’s products, services and events;
  4. Respond to users’ requests sent via the Site contact form and follow up on them;
  5. Create and manage customer accounts for users of the Site;
  6. Manage and improve the Site;
  7. Carry out analyses and produce statistics;

(the “Purposes”).

The processing of this Personal Data is necessary (i) for the performance of contractual and/or pre-contractual measures for purposes a) and b) or (ii) to meet the legitimate interests of VIVELYS for purposes c) to f).

The processing of certain cookies used on the Site is based on users’ consent.

In the context of its commercial relations, SEGUIN MOREAU may use Personal Data for canvassing purposes, subject to obtaining the express prior consent of the persons concerned.

 

5. Recipient

The recipients of Personal Data may be:

  • SEGUIN MOREAU, OENEO and its subsidiaries;
  • SEGUIN MOREAU’s commercial partners.

SEGUIN MOREAU may use subcontractors for specific technical services, for example in connection with the hosting of the Site and the distribution of information relating to its products, services and events. In this case, SEGUIN MOREAU will contractually define the conditions under which subcontractors may access the Data.

For these Purposes, SEGUIN MOREAU may transfer Personal Data to countries outside the European Union. Where applicable, SEGUIN MOREAU will ensure that such transfers are contractually regulated in accordance with the applicable Regulations.

 

6. Data collection conditions

Only the Personal Data (i) required to enable precontractual measures to be carried out and/or a contractual relationship to be established or (ii) marked with asterisks on the Site are mandatory.

If this is not the case, SEGUIN MOREAU will not be able to (i) establish or execute the contract or (ii) respond to requests or create or manage client accounts for users of the Site.

All other Personal Data is optional and enables SEGUIN MOREAU to meet the above Purposes.

The processing of Personal Data by SEGUIN MOREAU does not result in any automated decision making.

 

7. Duration of storage

The Personal Data collected is kept for a period of:

  • three (3) years after the end of the commercial relationship and up to five (5) years for the purposes of managing a dispute for the Personal Data of customers, intermediaries, suppliers and service providers;
  • six (6) months after the last contact with the candidate or, where applicable, for the duration of the employment contract and thereafter until the expiry of any applicable statute of limitations or legal periods, in the case of Personal Data relating to candidates;
  • three (3) years from the last contact for Personal Data of users of the Site;
  • thirteen (13) months from registration in the user’s device for Personal Data collected via cookies used on the Site.

8. Rights of the persons concerned

In accordance with the Regulations, the User may access, rectify and request the deletion, portability or limitation of the processing of their Personal Data by sending a request to the following address: rgpd@oeneo.com.

If, after exercising their rights with SEGUIN MOREAU, the user is not satisfied with the response they receive, they may submit a complaint to the CNIL.

9. Version – Updates

The Personal Data Processing Policy currently available on the Site is the only enforceable version until a new version replaces it. SEGUIN MOREAU reserves the right to modify or update it at any time without notice.
